Personal injury compensation a windfall?

Hi,

Not sure if anyone would be able to help. I am currently just under 2 years into my IVA. I was involved in a car crash just over a year ago which has left me with quite substantial injures/health issues.

I am pursuing a personal injury claim and it looks like it may be settled in the not to distant future (fingers crossed) and I wondered how any compensation payment is likely to be viewed. I've read conflicting things, one suggested it would be treated as a windfall and the other stating they couldn't take it into account as it was due to injury/disability that is ongoing?

Has anyone heard of or experienced this scenario?

    Hello there, the general rule with insolvencies is that the personal injury element of such a claim would not be regarded as a 'windall'. The non-personal element (e.g. loss of earnings) would be.

    It would be important to check the terms and conditions of your IVA and to speak with your IP to see if they would follow this rule.

    Thanks for that answer. Good news as we would like to keep at least some of what we get to make adaptations to the house so that I can get around more easily.
