Employer didn't send me SSP1 form

Hello,
Hope someone can advise. My employer stopped paying me SSP in Jan 2012 which had been exhausted due to long term sickness and have been off work sick since. I didn't realise I wasn't being paid SSP although I was receiving Occupational pay. I realise now that if my employer sent me the SSP1 form in January as they should have I could have been claiming ESA. If I explain this on the ESA application form, will the DWP backdate ESA payments to January as it was an oversight of my employer? I have a letter from my employer admitting their oversight which I intend sending with my ESA application form

    As far as I know the absolute limit for backdating is three months

    Having said that there is no harm in trying.

    Is it contribution based ESA or income based ESA?

    Contribution based is for 6 months only so if it is this then you'll get the same money whichever decision they make!

    Contributions ESA is for 1 year from April this year. Prior to that it was whatever the date on the award letter said. So not 6 months. JSA on the other is the 6 month one.
    But if you can get into ESA support contributions group, then it can go on for a bit longer. Which is the group I need to be in with my incurable illness and long term drug treatments and side effects.

    Its not only your employer to blame OP, you could have got your own form its probably downloadable for you to complete and send to DWP.

    Its contribution based ESA i'm claiming, i'll give it a try, nothing to lose, pointless question I asked thinking about it. I'll let you know what DWP's decision was when or if I get it anyhow.

    Just an update on this post for anyone's info. I applied for the backdated ESA but DWP only backdated it 3 months as suggested they would by some of the replies I had.
