  • Do you care for him for thirty five hours or more each week? Does this caring contradict your reason for being on Incapacity/ DLA?

Are you caring for him in excess of 35 hours a week?
If so, then yes, you can.
However, he may be able to directly claim the 'severe disability premium' - this would add to his benefits, but cannot be claimed along with you claiming carers premium on your IB claim. http://www.benefitsnow.co.uk/esa/rates.asp

i am with him 8 hours a day known him for 4 years looking after him for 2 years.

incapacity and dla was claimed at the age of 17 due to illness as a child.

my friend gets middle and low rate dla hes got it for 5 years.

But do you provide care for him, and do these duties contradict the reason why you claim Incapacity?

no, i just spent time with him as hes got a mental illness.

Spending time with may count as caring, if it alleviates his illness.
