Creditor Calls

Hi,

My Husband and I have our court date tomorrow at 9:30.

Can anyone tell me when our creditors will be told about our bankruptcy?

We owe some money to a local business and they have started calling round the house. We have so far not answered the door but I don't think we can continue to do this much longer.

The stress of all this is really starting to get to me now, I just wish they would go away.

    The OR will notify your creditors in 8-12 weeks.

    Once you are bankrupt if you receive calls or visits then you can either ignore them or just give them your bankruptcy number, the court your went BR in and date. You can refer them to the OR for all enquiries.

    Once you are BR I would phone or email the companies that are hassling you, inform them you are BR, give them the court that it was ordered under, the reference number and the name and address of the IS dealing with your BR. Tell them your estate is now in the hands of the OR and all communications should therefore be addressed to them. I'd be the same with people at the door, ignore them.
    I emailed the one creditor who was a pain in the backside and haven't heard from them since.

    Would it be OK if I wrote to them all tomorrow afternoon to give these details? Would save abusive phone calls.

    Also I have a feeling that the local comapny will still call round the house even after tomorrow, can we do anything about this?

    write to them all and enclose details of your bankruptcy to anyone who calls also give them your bankruptcy order you might still get phone calls and letters but just tell them again and it will all die down

    as for your local company are they legit lending company? if so give them the details and if it dosent stop tell them you will be contacting the official receiever things should calm down when everyone is informed just takes a little while

    Yes, they are a legit company. They have called round again is afternoon and I am now sitting with curtains closed as I don't want a scene in front of the neighbours.

    If they harrass me too much can I call the police or is this not something they would deal with?

    if you have been made bankcrupt just give them the bankruptcy order no and your details of your official receiver they shoudnt bother you again

  • I agree I would write to them and perhaps phone them in this instance, the OR does inform people but it takes time.

    Check with your debt charity what your rights are re the doorstep callers as I can understand you not wanting to explain this face to face at the doorstep with the danger of being over heard. If you call their offices and explain that you are BR, give your number and the OR's contact details that should help, esp if you re-iterate that you are no longer able to discuss the debt with them.

    I found the phone calls and letter stopped really quickly, the ones I did have went away once they had a BR number. We did change our phone number which I am really glad about as I KNOW that when it rings it isn't a creditor (even though the mobile & work calls have stopped too).

    Sweetie, please do not worry too much. As long as the debt to them is included in your bankruptcy, just point them in the direction of the OR as others here have suggested - they'll tell the firm to pack it in sharpish.

    Don't contact the Police; as this is a civil, rather than a criminal, matter is it unlikely that they will be able to assist you (UNLESS the person(s) in question are threatening you, your friends/family/house/other property with actual physical harm - in that case you MUST report them to the Police).

    In the unlikely event that (assuming no threats as described in the paragraph above have been made) the OR's contacts with the local firm fail to stop the harassment (and the debt IS included in the Bankruptcy) then your best bet would be to inform the local trading standards office.

    Good luck to you and your hubby, KimLyn. I know life is unpleasant and difficult at the moment. But you have made the all-important (and hardest of all) step on the road to recovery now. I wish you all the very, very best for a happier and brighter future.

    And I bet ALL your neighbours' lives, behind their curtains, are far more sordid than yours. At least YOU have now done the decent thing...!
