CSL-sale of good act?

Friend of mine bought a 3 piece suite Jan 2006 from a CSL. In the march, the seam unstiched and they sent someone round straight away to repair it-fantastic!,until July when it happened again-sent someone again repaired it,happened AGAIN in November and they explained they werent happy and they wanted it replacing. They wouldnt and offered a repair. It then happened in December and when the man came to repair it my friend asked if it happened after January( the year after it was bought and outside the guarantee) would it be covered-of course it will was his reply.
Guess what happened in Febuary? EXACTLY the same problem and they have said that it is wear and tear and that it is no longer covered at is only 12 months old.
Anyone any ideas? she has written to them and they have catagorically told her "wear & Tear".
surely not? 2 adults in the house? both work full time?
Any help?

I wouldn't say it was wear and tear if it had happened so many times before.

Sounds like you have a case under the sales of goods act, a settee should last years okay some wear and tear after a few years perhaps but if this problem persisted after only a few months and subsequent repairs there after I think you been more than reasonable. Unfortunately you have to take them to the small claims court.
Perhaps write them them saying that you reject the goods under the sale of goods act and explain the dates when repairs have taken and given them 7 days to respond in writing for a full replacement to the value of what was spent or you will sue.0 -
It is far too late to reject the goods now. They have also had the use of the settee and the rest of the suite for over a year so they are certainly not entitled to a full refund either.
There does appear to be an argument of not fit for purpose (you don't expect a settee to rip just because you sit on it) but again, a deduction can be made for the usage of the furniture in the meantime.0 -
I am a definate firm believer in getting your money's worth out of something, and this suite hasnt lived up to the standard of workmanship you expected it to.. you should request a full refund or replacement .. I did with comet and a tumble dryer that went faulty after 13 months...there is always room for negotiation, and remember its your hard earned money thats in their pockets for shoddy goods...keep persevering, go higher than the showroom staff, go higher than the supervisor, go higher than the manager of the showroom, go straight for the jugular...hit the man at the top.. my next email was to the managing director of Comet.. they hate getting these sort of emails.... know your rights expect nothing less...0
