CTC 3 months backdated

Has anybody managed to get more than 3 months CTC back paid? I didn't realise we could claim and our son is now 10 months old.

Seems unfair that there is a 3 months limit if they owe you but they can claim as long as they like if you owe them.

Thanks

If this is your 1st child, you can request it to be backdated to DoB.

Just need to call the Helpline

Got a bit of a problem here as I've never really understood tax credits but now I'm finally getting my head around it, it looks like we've missed out.

My partner has been claiming as a single person and we've only now got round to trying to get our finances staright as she has given up work after maternity leave so a £30K drop in annual household income is a bit painful at present.

She has spoken to the TC helpline and initiated a new joint claim.
But we have to pay back 3 years of TC (£1500) but our new claim has only been backdated 3 months.

is there anyway we can get the claim backdated to the start of the 06/07 tax year. Our son was born early into that tax year.

    Thanks

So... you now have two children together, so I'm guessing you've been living together for a while. And you've got to pay back three years' worth of Tax Credits, so presumably you never told them you'd moved in together, and it's a Single Claim you've got to pay back.

I know Tax Credits are confusing, but the one thing they make crystal clear is that you must tell them immediately about any change of circumstances, especially a major one like moving in together or splitting up.

I know I'm assuming a lot, so I can't really advise anything without all the information.

    The only 2 areas that qualify for backdating further than 3 months is;

    1st child
    Disability

It's my first child, but partners second.
  • Actually it doesn't matter how many children you have. Backdating beyond 3 months only applies in cetain disability cases or where you've been waiting for a decision on your asylum application. It doesn't apply to first born children. The normal 3 month rule applies.

    Not true.
    Example 1

CTC only awarded claims where there is no IS, JSA (IB), or PC interest present. The claim will be automatically backdated to

    * 3 months prior to the date the claim was recorded as being received

    * The date a new child was born, where there is only 1 child in the family

    Or

    * The date responsibility for a child commenced, where there is only 1 child in the family

ps. this also answers GAMBLERs question about whether she would qualify for further backdating as it's her 1st child.
