Thanks And Im Going For It

Hi all well can i say thank you, too all that has given me advice, over past few months. :money:

I now have my date, to go to court, next tues. SO i can file my bankruptcy. I cant wait, but at the same time, really cacking my pants.:eek:

Can someone, just tell me what happens when you get there.please
Ive been been near a court let alone in one. But i do know, i will be having a drink once its all gone through:beer:

    it really depends on the court as to the procedure but i can give you my own experiance.

    arrived at court at 9.45am booked in was meet by the bankruptcy clerk who took me into a private room and checked over my printed off forms once this was done i had to swear on the bible then the clerk went upstairs to the judge who stamped the relevant paperwork(i never had to see the judge)

    then went back to the clerks office where she photo copied my forms and gave me my copy and said that the official reciever would be in contact ,and that was it i was in and out within 2o mins .

    i cant see any reason why not i took my 2 year old with me .

  • Hi

    I had to see a judge. My story is very similar. Went in paid clerk who read through my forms, then i had to swear on bible. had to sit in court waiting room for about an hour as I didn't have a time slot, just had to wait for a break in court so i could see a judge. But it was interesting earwigging!! Anyway, popped in to see the judge, he quickly flicked through my forms, asked if i was sure about doing this as i had a relatively low debt (£14,000.00) I said 'yes', he stamped my forms. Then back upstairs, clerk photocopied my forms, i went into a room called OR who said they'd be in touch and that was that.

    My OR call came a week later, took about 15 mins and not heard anything since (8TH Jan). They said they'd be in touch in about 6 months to see if my situation changes (i.e I win the lottery, get a better paid job etc), but thats all.

    It wasn't scary at all, please try to relax you will feel fantastic soon as its done!!

    Timesvary according to court but generally there is some waiting around involved.

    Arrive at court
    Wait around
    Check in and have paperwork checked - swear affidavit
    Wait a bit more
    Called to court ( we went to chambers so no open court)
    Judge asks a couple of questions.Wishes you all the best and declares you BR
    Wait around a bit more
    Get copies of your paperwork from the office and notice that the OR will call you.
    You could be in and out even with the waiting in as little as an hour
    Go to the pub and reflect on the fact that you do not owe anyone a sigle penny
    Go home and wait around for a day or two( or maybe longer depending where you are)
    Take the OR phone call - time from 15 mins up to a couple of hours - no set time
    Have stiff drink
    Sleep the best sleep you`ve had for ages

    TJ says it all really!

    For us whole experience was quite surreal, as others have said, turn up, hand over papers, wait for photocopying, swear on the bible everything in papers was true, pay an awful lot of money for 2 of us to go BR, wait, go into chambers to meet judge, assure him we had taken legal advice and we were sure it was the right way to go, he reminded OH that his student loan would still be payable, wished us luck, waited, given paperwork, lots of good luck wishes from clerk, receptionist, security guard, went round to OR, chat, booked appointment for 2 weeks time, went home, got !!!!ed, laughed, cried.... and yes best night's sleep since forever!

    2 weeks later had big meeting with OR, he talked us through our situation and wrote lots of notes, we agreed the notes (statement) was correct, went through budget sheets (previously done with CCCS who are fab) all figures agreed.

    1 week later had letters confirming that both our vehicles were safe and our computer and asked us to keep in touch.

    Had a few contacts from creditors during this time, gave them our BR number and OR details, they stopped ringing and writing.

    That was last November and we can see the light at the end of the tunnel... nearly!!!

    We go to court tomorrow.With my local court,you go in,see the clerk,do the paperwork then have to come back another time to see the judge! I wish it was a 'standard' procedure everywhere.

    Good luck, You will be fine. It isnt as daunting as you make it out.. once your in its over fairly swiftly...

    Are you taking the baby.. make sure they dont think its an assett and take your baby :eek:
