They aren't saying they wont settle the claim, they are saying they wont pursue the council for it as prospects of winning are too low0

This is genuinely an accident, and proving negligence would be impossible. Indeed I recall an issue tha went to court and the driver was told he should have been aware that items may be thrown into his path by the cutters. As long as the equipment had all relevant guards in place (it had) then the contractor was n the clear.
Further, when the car in front catapults a stone into your windscreen the same holds true - they are not liable and insurance claims are routinely rejected.0 -
