eBay, scammer?

Sorry to be lazy, but I will just copy and paste what my hubby posted on another forum. What do you guys think?
I have just contacted an Ebay seller, as we haven't received an item after one week, i was advertised with 24 hour delivery.
When asked about this item, this is the message he sent us
HI
your item should have been received by now,please forward your address and we will despatch you another,are if you wish refund you
will claim off royal mail for this item,they may wish to speak with you,has they are doing a check on my account.as they are saying i am putting more then average claims in
sorry for any inconvience this may have caused

I no longer trust him to send the item, and I know that it isn't me that needs to claim from Royal Mail.
Would you give him another chance to send it, or just stick in a Pay Pal claim immediately?

I think your seller is being reasonable; they have offered you a replacement or a refund. They are only asking you to co-operate with a claim.
I'd probably ask him again for a refund as he promises, and then open a dispute if he doesn't send.
What was the dispatch time on the listing (yes, I know you say 24 hour delivery, but that could be delivery 24 hours after posting)? One week isn't normally the point at which I would give up on the item, and it does actually sound like the seller has sent it if they are prepared to offer you a refund. Most people who haven't been bothered to send it would either say 'sorry, it will be in the post tomorrow' or just ignore you.
I'm not saying you should not open a claim, but it is early days yet, and it looks like the seller has a problem at their end if they say they will replace or refund - because they may know that there's a problem but still decide it's worth their while risking it (I wouldn't, but it's their loss). I think you're misreading his message & intentions.
He says he will claim from royal mail (not you) and asks that you cooperate with any investigation. I've read on this board stories of sellers not getting a refund from RM because their buyers don't respond to RM enquiries.
Is there any other evidence of 'scamming' - What's his feedback like?0 -
I'd give him longer- he's communicating with you, he seems to be being reasonable. See if the next one turns up - you still have plenty of time to put in a dispute.0
