Is it my fault if a company didn't take a DD from my accout?

A comapny failed to take a direct debit from my account in early 2011 as in it was set up but they didn't take it. They have literally just informed me that I owe it? Is that right?

Only if they can prove it.

It may be their error that they failed to take the payment but you still owe for whatever goods or services that you received. Debts can be claimed for up to 6 years.

What was it for exactly, as that may shape our advice to you?

(But generally, they should have called for it and you should have noticed that they didn't).

What alanq said. You still owe the money even if they didn't take it at the time.

Think of it as they have given you an interest free loan for the amount.

The fault of why they didn't get paid only has an impact on what penalties are appropriate for the non-payment. Irrespective of who's responsibility it is the money is still owed. Only after 6 years can you put in the argument that it is statute barred for it having been too long since it was due for them to recover it.
