Contesting a ticket

Hi guys, rightly or wrongly I havea parking ticket and would just like some advice.
My wife stopped and parked in ataxi rank, a clearly sign posted taxi rank and we're in breach of contraventioncode 45.
The vehicle registration iscorrect, the Colour is correct, the tax disc is correct, the car make isincorrect. The observation time is the same as the issuing time, but I assumethat won't matter because we were in a zone that is no stopping at any time.
The situation was, my wife hasliterally just given birth, she was driving home with the baby and startingfeeling dizzy and felt like she was bleeding, which it turns out she was. So she pulled over and stopped and rung me tocome and get her. Whilst she waswaiting, she got ticketed. There weretwo cars in the taxi rank as well which were not taxis. A Renault Clio (the ticket marks us as aRenault, when we are a Peugeot) and a Toyota Yaris. The person issuing wasn’t in full attireeither. Trouser and a shirt. No high-vis jacket etc.
Can we contest this? Will the safety issue of driving have anybaring?? Can we use the incorrectinformation as something to argue this? Also – I don’t know if it matters, but the traffic warden didn’t takeany photos. He just ticketed and walkedoff.

I'm not an expert on council tickets, but incorrect make and not taking photos are not good enough reasons to contest.
However it may be possible from the safety angle, could you get a doctor to verify the condition of your wife at the time?
Hopefully others more qualified than me on council tickets will post on this thread soon.Je Suis Cecil.0 -
Yes - all the critical info is correct and the mistakes are on the less important stuff. Photos are at best the bottom of the evidential food chain and would only be considered after all the important stuff had been tested.
You do have a good medical reason/explanation, so I would certainly write them an informal challenge, outlining this. If they reject that, then get yourself over to Pepipoo and discuss the technicalities for a formal appeal.0 -
Who has issued the ticket ?
Full details please ?
If this is a council ticket and they are many fakes, most taxi ranks are incorrectly signed and that is the line of attackHi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -
Bucks County Council issued the ticket. She was in High Wycombe town centre. The 30 minute stopping zones were all full, there are alot of pubs and fast food places near where she stopped.
She stopped in the taxi rank because it was all but full.0 -
Get some medical evidence of your wife's problems and the council should cancel the ticket as 'circumstances beyond the driver's control'.0

Do you have a picture of this taxi bay or can you find a link on google street view.
I have yet to see one that has been correctly marked, you may be the first but lets hope not.
If the signs and markings are out, the ticket will be overturned at adjudication.
HOWEVER : The council will rubber stamp the two appeals as failed, you must be in this for the long haul to adjudication or if not pay up now and save the extra penalty.
I noticed they have put time issued and time observed as one of the same, if the sign and bay is wrong, its game over for them with two times the same.
Ignore the no stopping rules, this is for PARKING in a taxi bay, they can not change it so lets stick straight to the point.
Cut the sob story as well, it wont help.Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -

This is the closest I can get to it. Its on the opposite side of the road with a silver taxi parked in it.0
