problem with buyer anyone got some info?

hey there folks jsut like to say this site is pretty good everyone helping out with their own experiences.

basically my situation is this i bought an item on ebay a watch with a designer label "face" ie a shneid, a replica ie not real i read the listing and thought oh well i like it no one will know so fine the seeller had good feedback listing was accurate was all good. bought the item came ok.

now thing is i have listed it on ebay using the exact same listing i bought it from jsut copied and pasted it sold it for more than 50% less than i bought it for complied with ebay policy i got a rating of over 120 never had any problems listed correctly picture of the item advising sold as seen no box just the watch no refunds all sales final all that sorta carry on now.

guy bought it from france althought i said uk only i posted it offf to him there after emailing him re this he got it and clearly had not read the damn listing only assumed was a real item he emailed me to that effect and procedded to give me abuse in emails advised him if had a problem with it contact ebay/paypal re this as would not deal with him as obviously a nasty piece of work, claim has been made against my item and payal currently dealing with , i have obviously got my side over emailing them off explaining item listed correctly and this idiot clearly did not read it.

can i have anyones views re this possibly its happened to someone else out there some idiot aint read the listing. Its only for a mere £10 but its the principal of the matter!!

before anyone says i am not one of those fraudulent sellers that rip people off i have sold items from my phone to ps2 computer games all sorts 100% feedback all the way.

thank you

Just the fact that he's French and might not understand might help you see where he's coming from? That's no excuse by the way, because I'd never bid on an item listed in French - unless I was fluent in the language.

But if you stated UK buyers only, isn't that enough?

Someone with more savvy than me will know better, but those are just my initial thoughts for what they're worth.

Was the item clearly listed as a fake?

Is the buyers complaint, that he has received a fake item?

    EBay's rules aside.....

If the answer is yes to both, then the buyer does not really have cause for complaint.
If the answer is not yes to both, the buyer may well have cause for complaint.

what is the buyer actually asking for? a refund? if so tell him to send the item back to you less the postage (that will do him out of pocket!)

or persevere with ebay and paypal! I bought a Von Dutch Tshirt once for my sis that was clearly a fake! the size was way too small then it should have been so I listed it again! I included the item number of the last listing I bought it from and said that I recieved this fake very clearly etc! anyway the person who bought it complained "how dare you sell me a fake tshirt and pretend its not!" I explained to go back and read my listing carefully, I said it was a very nice tshirt but obviously a fake....she went quiet after that!

....what is this guys english like? you could perhaps find the translator program on here and politely say FO icon10.gif

Ebay do not allow the selling of fakes or replicas:

    http://pages.ebay.co.uk/help/policies/replica-counterfeit.html

That may mean that whatever your listing said and however it was misunderstood by the buyer Ebay will still find against you in a dispute and possibly even place a warning on your account as well.

The fact that you bought the item on ebay in the first place doesn't matter, just because that violation wasn't picked up, doesn't mean it was oK to relist it.

To protect your account it might be worth offering a refund in this instance and blocking the buyer for future auctions.

Yep fakes are not allowed as is cutting and pasting someones listing (hmm).

Think you will find you are onto a loser here. I would get it back and try relisting (if you can get away with it) highlighting in bold that it is not real.

Otherwise I think EBay will take his side.
