IB switch to ESA for a couple

My MIL and FIL bothreceive Incapacity benefit. My MIL was sent an ESA form to fill out.They would most likely receive contribution based ESA because theyboth worked up until the point they became ill. My question is whatwill happen next as far as ESA being couple rate rather than twoseparate claims for IB? Assuming my MIL is successful in her switchto ESA and she receives the couples rate will my FIL's IB stop, orwill her ESA be reduced from his IB? Also My FIL receives a privatepension and was wondering what bearing this may have against thecontribution based ESA? Also when my FIL contacted the Job centrethey said that he might not have to go onto ESA because his IB hasbeen going for so long (around 15 years), but this didn't seem rightto me. Any advice or help is appreciated.

i would assume that they both keep their existing claims. if both were successsful they would get CB ESA for the 365 days and hen be put on icome related as a couple ( if put in WRAT)0

As Nanny has said they will both stay on individual claims, how much is his pension?
I was on the predessor to IB, IVB and I was on them for over twenty years yet still got transfered to ESA so who ever claimed long term IB claimant wont be transfered is wrong.
I was transfered a couple of weeks ago into the support group of ESA as Im severely disabled, I would advise your MIL to go and see the doctor she is registed with to update them on the current state of her health so if a preboard report is sent to them they can fill it in with the updated information and also she should collect reports from everyone involved in her care including district nurses, OT and physios to send in with her ESA50.0 -

His private pension is £900 a month.
They both receive DLA. She receives middle rate for care, lower rate for mobility. He receives middle rate for care and higher rate for mobility. Which is the only other money they receive, that I know of and that I haven't already mentioned.
My FIL read that you are only allowed £6,000 in capital, but from what I read that was only for income related ESA, is that right?

Two single rates are more than a couple rate so yes it would be better. They will both in time be changed to contribution based ESA. This will be limited to one year if the wrag and after that become income related which will have to be a joint claim.
there are no capital limits for contribution based.Lost my soulmate so life is empty.

Also because your father claimed IB before 2001, he will have protected right iro of his pension when he goes over to ESA....0

If your MIL fails the medical she will need doctors sick notes from the date they stop the claim in order to receive payments on appeal, so she needs to be sure her doctor will comply with this request. If she has to appeal she will recieve £71 per week
If she passes the medical either WRAG (1 year only as a single claim)
or Support group ongoing as long as it takes...
Meanwhile FIL IB claim will continue as it is now.
More than likely FIL will migrate aswell in the next year
If she is in WRAG they will have to claim ESA IR when her 365 days are up. When they claim ESA IR their capital will be looked at. more than £16000 and it's no dice. If they spend capital now in anticipation of this they could be looked upon as still having the capital they got now under deprivation of capital rules.
Sounds like quite a complicated claim they got going on there, I would advise calling Benefit Enquiry line 0800 882200 and get some advice they are getting everything they are entitled to and will do when ESA comes along.0
