solicitor mislaid/lost title house deeds

Hi-

Probate has now been granted and have a buyer, all paperwork on house sale done i.e. fixtures fittings list and gen info.

I have proof that title deeds are held in strongroom by the solicitor for this property This is via a letter from them in relatives house, papers and documents.


Solicitor as yet can not find deeds and think they could have been misfiled. I am very worried we will lose the sale as we had to wait a number of weeks for probate.

Solicitor is still looking but says may take some time as lots of old records to go through. Can copies not be obtained though land registry office.

    If the house is already registered at the Land Registry then that record has replaced the title deeds.

    You'd only need them if there was some reference in the LR documents to clauses etc in the title deeds and an extract from the deeds does not form part of the LR documentation.

    Is the property already registered?

    Thank you for your response. I am not sure if it registered I will try and find out. Will speak to solicitor on Monday and see what he can come up with.

    Hi

    Have just gone online to land registry and done a search looks like property not registered with them. I have proof of ownership via letters and paid up mortgage details etc etc.

    Hopefully solicitor can sort it all out.
