Hire company stole 250 quid

Hello all,

I hired a van in Febuary, and paid a £250 deposit. This still has not been refunded, and I have the return form with no damage.

Then a week ago they took another 250 from my account, I phoned up and they told me that they were trying to refund my deposit, and took 250 in error.

They told me it would all be back in my account on Wednesday, that did not happen.

I phones again today, and they told me it will be back in my account on Wednesday, I do not have much confidence.

I phoned my bank, Halaifax, and they said they could no nothing about the deposit , and I had to wait 15 days to do anything about it the second transaction!

So what can I do? I am fuming that a company can do this, what if I could not pay my rent because they took that 250?

Many thanks

Then you would have a valid claim for your out of pocket expenses.

Have they stopped you paying your rent?

No they haven't, but for someone else that 250 could have meant real issues.

Write a letter, keep a copy, state what has happened briefly without going off on one. Tell them that they have 14 days to refund in full or you will take the matter to the small claims court.

edit: Don'r accuse them of stealing, it muddies the waters to accuse them of malice, if it is just incompetence.

I agree. There is no reason why the payment should not be in your account 5days after they claim to refund it.

Issue a letter giving them 7days to have the money in your account or you will issue a claim through small claims court.

You can make the claim via the internet.

Phone your bank and report the transaction as fraud - they should be able to action a chargeback straight away. If they refuse (I can't see why they would) then wait the 15 days and phone again.

Court action is pointless and a waste of money when the same result can be achieved via the banks procedures.
