My listing copied! Advice please

I have just discovered that another seller has not only copied my listing word for word but also used my photograph - clearly identifiable as the items are on my kitchen carpet!:mad:

This is not really a big deal in the light of the fact that I have just lost my father and am in the throes of having to sell our home and move god knows where asap to pay inheritance tax and stressed out of my mind so my judgement is all at sea.

On the other hand I don't see why she should get away with it, but am afraid I might over react as you will appreciate I am not quite my normal self in the moment! I was thinking of sending the following e-mail to her to give her a bit of a fright:

"I note that you have not only copied my listing but also used my photograph both of which are my copyright.

I refer you to ebay terms & conditions user agreement section 8:

Additionally, you agree that you will not:

copy, reproduce, modify, create derivative works from, distribute, or publicly display any content (except for your information) from the Site without the prior expressed written permission of eBay and the appropriate third party, as applicable;

etc.

Can you give me any good reason why I should not report you to ebay and ask them to exclude you from trading?"

Could I have some cool :cool: calm rational advice - should I bother or just ignore it:rolleyes:

    Hi, I would (and have in the past) contact the seller and say 'I can see that your listing is a copy of mine including my photographs, perhaps you aren't aware but this is against ebay policy. Could you change your listing and remove my photographs, thank you.'

    Has your listing finished? If it has, I wouldnt bother taking it further. If it hasnt, report the fraudster to the ebay police

    Yes my listing finished but it is an ongoing item I am about to list again and the reason I spotted the wicked woman is because I was checking to see if anyone else had the item listed in a better category!

    Yes I think you are right - I don't need the aggravation.

    The good news is there are 14 hours left and she didn't sell the item yet:p
    whereas I did:j :j :j :j

    I guess life is just too short for the hassle - cheers one and all :beer:

    The same thing happened to me, the seller used my photo and wording...so i reported him (via the same link as above) and ebay removed the person's ad.

    I'd recommend using something like paintshop pro to put in a watermark so your picture cant be copied.
  • Ive had that happen too but never bothered to report it-all hassle-I just let it pass. When you are feeling better though watch out for it in the future and chase it up.

    i'd send Ebay a letter by recorded delivery stating your concerns and include a piece of your kitchen carpet as evidence.
