When I terminate and pay the rent, can I leave before the end of the notice period?

Hi All,

Let me try to explain.

I will send my termination letter on Monday. Contractual my monthly renewal is on the 9th of each month, at least that is when the rent is due.

Landlord came around on Queens Jubilee to tell us he wants to move back in, but did not give a written notice and has given us 3 months additional time to find a new place.

We now have found a new place and are accepted for the lease. Since we have a dog and the new landlord accepts the pet, we are over the moon.

When we move out I don't want the landlord to hang around and also I want some time to clean the house. Since we pay the rent for the full month, can we let say move out on the 18th and give the keys back on the 29th? Do we break any rules doing this?

I can't find anything in the lease contract and since we pay for the full month, I'm technical renting it.

I'm not British so I would be grateful if one or more of you could advise please?

    Some contracts state that you can't leave the property empty for more than 28 days, but I can't see 11 being a problem - it's less than many holidays! Just do a quick check that nothing has changed to affect your deposit (you might need to cut the grass again for example) and I'd have thought you should be fine.

    If the landlord wants you to leave, and you also want to leave, the best solution is to have a discussion.

    There is nothing to stop you agreeing to ANY date to end the tenancy, and ANY conditions related to that ... provided you both agree. Get it confirmed in writing.

    If however, you cannot agree, then the law says:
    Contractual my monthly renewal is on the 9th of each month, at least that is when the rent is due.
    These are NOT always the same. Ignore the date you pay - it is the contractual date that matters.

    As you'll see from that post, you have to give a full rental period notice - this as at least a month and may be longer depending on the dates involved.

    The amount of time you're proposing to leave the property empty shouldn't be a problem. As long as you give at least a whole tenancy period as notice, pay up to the end date, return the keys by that date and return the property in as good a state as when you moved in (less fair wear and tear) then you've met your obligations.

    There is no need for you to tell the LL that you are moving out before then end date incase he thinks it means he can start entering the property and commenting on the state before you've finished cleaning it.

    As mentioned above, I'd talk to the LL. Chances are they'd be over the moon at being able to get back in early but gave you the 3 months because they felt bad about it.

    Thanks for pointing that out! Indeed the contract has exactly that clause but 11 days as said would then not be an issue.
