    Does the fee apply to a property exchange the same as a sale, have they covered this in their contract?

    Presumably, the EA could argue that they did in fact introduce the buyer because they introduced you to them in their capacity as a seller. Not sure if that's right but just a thought

    Well, it looks like the EA has found out we are selling because the surveyor was part of the same company. Doh.

    The EA in question has had nothing to do with the sale whatsoever. The house we are buying is with a different EA.

    The Vendors EA is off the opinion that several of the things that our EA did were dodgy. Signed in the home (no cooling off), signed whilst still under contract to a different EA to sell, and viewings carried out whilst under contract to a different EA (not sure that's relevant). Combined with the not pointing out the details it's not squeaky clean from my point of view.

    We have a few friends using the same EA and are looking to see if they have the same contract.

    Ultimately we need to decide if it's worth challenging it or not.
