    They very well may, but if they're in the vehicle they won't be classed as an independent witness and for the purposes of liability will be inadmissible.

    Stick-in a claim and tell the insurers you will not settle for a 50/50.
    As the oik was really abusive and you have his address, why not report him to the Police.
    Down here in Essex they treat 'road rage' very seriously.

    I understand your anger, Ive been hit twice but was lucky enough for the people who did it to wait (i wasnt in the car)
    but when you said 'screw him over' it sounded pretty malicious the first time you said it, to me it did anyway,

    He did make a mistake, he was probably so angry with himself he just took it out on the first person he saw, we've all done it.

    Have you informed your insurance company.

    Of course you're right but when it comes to the crunch (sorry) for a minor bump I'd be looking at trying to get things sorted without involving the insurance co's.

    Months of faffing about before they decide it's 50-50 & you lose (possibly) some no claims. Even if you don't you'll have to declare the claim for the next few years generally resulting in increased premiums... all for the sake of £200 damage! Nope, doesn't appeal to me in the slightest.

    Yes it's a risk & you have to be dealing with reasonable people but it can be done, although in the OP's situation they don't seem the reasonable type ;)
    Always try to be at least half the person your dog thinks you are!
