Undefended divorce

    Well, yesterday went without a hitch *phew* :)

    My partner paid for a 'full and final separation' when they first split. Is that something the same as the consent order?

    I've been Money Tipped!
    Your partner will be able to apply for the decree absolute but will have to wait an additional three months after the six weeks and a day from when the decree nisi was granted.

    The direct gov website describes the whole process in a pretty easy to understand way that should allow anyone to get through an undefended divorce without needing a solicitor.

    No the financial consent order is different and refers to the division of marital assets. If OH is using a solicitor he needs to get this kicked off immediately as it can take a few months for each sides "discovery," unless they have an amicable split already agreed.

    :( I still don't get it! (Sorry if I'm being 'blonde' :o) I thought the f&fs would be the same as the consent order as it included the sale of the house and stuff on it. Will have to get partner to speak to his solicitor to be sure to be sure...

    edit: just checked with local CAB and they dunno what the difference is. or more precisely 'I am afraid I cannot find any explanation of these terms on our information system. If yu have a solicitor they should be able to explain them to you. I tried google but nothing there either.'

    This is called a 'clean break' divorce. Neither party can come on to the other at any date once the process is completed. Much better than the old idea of 'maintenance'.

    Had a read through his full and final separation documents. From what I can get out of it, it's the same as the consent order. Neither person can have any claims now or in the future in regards to property, pensions, or anything financial. Debts are the persons own and other has nothing to do with them. An agreement was also made in ref to maintenance.

    So I think we're good :)
