hubbys ex employer claims he owes money to them

hi there,

sorry if this is a long one but would appreiciate any help, please be kind am a newbie :)

Hubby left his previous employer last month 25th May to work for a new firm. He gave full 4 weeks notice and worked this (as according to the terms of his contract) to his manager, but his office failed to let head office know until 11th of june after he had left.
His HR dept have contacted him saying that he owes them £327.59 and if he doesn't pay they will be sending debt collectors :eek:

He got paid on the 25th June his usual pay date is 27th monthly. He has no copy of his docket as they are all done online and as he is not employed there anymore he cannot access them.

The problem we have is that we were under the impression that he gets paid in arrears not 4 weeks in advance as the HR advisor that he spoke to is claiming.

Is there anyway I can find out if this is the case? And does he owe this money as we were banking on the final pay to be on the 27th of June not 25th of may

    he has and the HR manager is adamant that he does i know in my heart he doesnt but how can he prove it?

    They can't just send round the debt collectors.

    You need to be sure what was paid when and for what period each payment is for.

    It is rare to be paid in advance by much.

    Many work on calendar months and pay it during the month near the end.
    other use different dates for the pay period eg 15-15 and pay at end.
    you need to know what yours is to deternine what has been paid/underpaid/overpaid

    How many days are they claiming has been overpaid?

    ask for copies of the pay slip and the p45

    If he has had any holidays since April that could account for the amount as holiidays are earned on accrued basis.

    What does his contract of employment say about payment dates?
    Can you check back to when he started to see how his first payment compared to his start date?

    no the holiday were calculated and he used those before he left,

    they are saying that he owes them money because they paid him until the 11th of july (in the 25th june pay) when they got confirmation that he had left, but his last day was on the 25th june.
    he hasnt got a clue when the cut off dates are for his pay it drives me mad that he is so lax with it all he never checks his dockets, he always leaves it up to me hence me asking the question on here i cant phone his old office because i wont have authority will i?

    also he went 6 weeks between pay in august 2009 because they were changing from 2 weeks in advance/arrears to 4 weeks in arrears but i dont have the letter which i kept until a few months ago when i had a big clear out :(

    Ask them to issue a final payslip and tell him to tell them no further correspondence will be entered in to until a printed payslip has been dished up

    the problem we have is that his 1st contract says pay in arrears and this company took over the old company and staff, he never had a new contract as it was tupe accross? the lady on the phone is saying they changed that to advance
    im lost :(

    I'm slightly confused. Are you saying that he left on 25th May, received his pay on 27th May and then received another payment on 25th June. If so then first of all he is paid monthly in arrears, but this is pretty much irrelevant.

    Your post isn't clear, but it sounds to me like he was paid for the period 25th May - 11th June, which is after he left the company. If so then he does have to pay the money back because it was a mistake and he was no longer working there.

    Was your OH paid into a bank account? And has he worked there for less than 6 years?

    If so, he could get hold of all his previous bank statements (if he doesn't already have them). Knowing his start date and the dates and amounts of payment would go a long way towards proving how he was paid.

    It seems unlikely he was paid in advance. Although holiday pay could come into this as katiedog suggests.

    Personally I'd go back to them saying I refused to even acknowledge this further until they can send me a breakdown of how they came to this figure.
