claim to the council for road accident

I'm not sure how running in to a curb is the councils fault!
Let me just turn it around, if I was walking and tripped over such a mess on the paviment would I stand a chance for compensation?
If the answer is possibly than why is it different if the damage is to the car?
If the curb regularly repaired it would not have happened
The school office manager (spoke to them today) does think I should write to the council and said that they have asked to repair it in the past which it was attemped to, hence the patch, but never made good0 -

Well just to play devil's advocate....you walk on the pavement, you don't drive on it and usually on a driving test nowadays....hitting the kerb/pavement can mean a fail....given its a pedestrian area and if you hit it, it usually signifies you are not in control of your vehicle yaddahyaddahyaddah
But all judgements aside etc. OP can you post the pics at all so we can give a better informed opinion? It is entirely possible we're just not picturing the same thing you meant. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
I'm struggling to picture how the kerb damaged the car - what were you doing when the stone from the pavement caught your bumper? Were you driving along the road? Attempting to park adjacent to the kerb? or had you mounted the kerb to park part on the pavement?Common sense?...There's nothing common about sense!0

You need to make more sense.0 -
The kerb didn't move, so how can it be at fault?0

ok ok have a laugh on me, its friday :-)
I will upload pictures from home tomorrow morning from home,
if you care to come back and see the evil curb I will have coffee and croissant
thanx for now0 -
You still haven't answered the question though - what were you doing?
If you mounted the kerb with your vehicle then you did so illegally and I don't see the council paying out a claim for damages that were incurred due to your illegal act.
Avoiding the question and trying to focus on the state of the kerb makes me think perhaps you know you were in the wrong.Common sense?...There's nothing common about sense!0
