I own a sandwich shop which sells hot and cold sandwiches. You can either eat them inside or take them away. We also do jacket spuds all can be washed down with a cup of coffee or a can of coke etc
The shop currently has A1 Planning
A1 Shops
Shops, post offices, travel agents, hairdressers, funeral directors, internet
caf!s, dry cleaners (but retail warehouse clubs are excluded).
Am planning to sell it, but the buyers Solicitor has said I have the wrong planning?
Have spoken to the Council and they do not have an issue. But that of course is worthless to a Solicitor
I should be able to get Certificate of Use as it has been selling hot & cold for well over 10 years and have reports from Councils Food Hygiene department to that effect, plus business rates etc.
The question nobody seems to be able to answer is, what planning do I need
A3 Restaurants and caf!s
Use for the sale of food and drink for consumption on the premises.
A5 Hot food takeaways
Use for the sale of hot food for consumption off the premises.
Any views on which planning I should have much appreciated

The number of A classes was increased a few years ago, previously A1 covered them all, thats why the issue has arisen.
If you can eat on site apply for certificate of lawfullness for A3 use.0
