problems with a garage repairing my car

hi,i am looking for advice on a problem i have with a local garage, who have been tring to repair my car.
my car went in to have a engine replaced in march and because i have only had the
car 2 years on a 5 year finace it was costing to much to be repaired so i asked the finace company to help me out, they aggreed and so the garage started work on replacing the engine, and a price was aggreed.
first off the engine that was first delived was the wrong engine that took a few weeks to sort out, then the first engine turned up with a fair few things missing on it.
well the first engine was no good, but they had to replace my turbo for that engine because the one on the engine to be replaced was the wrong type for the new engine.
this dragged on untill the middle of may, then they got another engine and in formed me last week that, that engine was also no good.
they then said they can still do the car for me but it will cost me another £1000 ontop of the current price quoted bring the cost upto arouns 2700.
anyway we had a look on the internet and found a firm that can do it for 1500.00 and have decided that we do not want the car repaired with the first garage as he has now had our car for over 3 months, and we feel that is a long time.
the garage are now tring to charge us the cost of the replacement turbo and is stalling on giving us a price, so still has our car,we are not being charged labour for the length of time they have had the car.we have asked for our original turbo back abut we have been told that it went as part payment for the replacement turbo.
what we need to know is has the garage got the right to charge us as the car is coming back not repaired and minus the original turbo
thanks

You really should refer to the terms of the agreement you have with the first garage.

In any event it is common to find that a garage will not release a car they have worked on without you first paying their bill.

If you are not happy with the work the garage have done, explain this to the garage and allow them to address your complaint.

Ultimately, if you feel you need to take the car back and are required to pay, ensure you do so "under protest".
This will help you if you later wish to take legal action over the matter.

I would urge you to take independent legal advice before making any decisions. Your local CAB office should be able to provide you with a list of local solicitors who may be able to help you, if needed.

Hi, Martin’s asked me to post this in these circumstances: I’ve asked Board Guides to move threads if they’ll receive a better response elsewhere so this post/thread has been moved to another board, where it should get more replies. To clarify

you asked them to replace the engine
the first engine they bought in required a new turbo, this engine didn't work
they get a second engine in, issues still

If this is right I fail to see why you should be liable for the cost of the turbo.

The fact of the matter is you asked them to provide a service and they have failed to do so.

Put your complain in writing if they won't release the car. If they still insist on payment, follow the above advise to 'pay under protest' then pursue it after.
