    Just an update on this

    Well it all becomes clear this debt was for a car loan which was started in February 2004 and can youguess which car Shark Company it was with begins with C and ends with crap answerson a post card please..........Car Craft

    Any how looking att he signed document they sent out it seems to be a top up loan of £1645.24 withOpen & Direct Retail Service on a £7000.00 car loan taken out in February2004 (which was also with Open & Direct Retail Service), With the last payment being made by me in September 2004 which makes sense as I came into some money and paid of the finance (or so I thought).

    It also shows that they then continuously tried to take direct debit payments from 7/10/04 everymonth up to 12/05/05 showing DD taken then the next day DDR returned thenon 11/05/05 DDSTOP1 then same date TERM 2, But none of these taken and refused DDs are showing on my bank statements.

    As both loans where with the same company and for the short time this was in affect they where takingout a single joint payment until I paid of the loan and even got a lower early settlement figure can I just tell them to go forth and multiply as not only is this over 6years ago I have a letter of full and final settlement from them dated 07/09/2004.

    Even if they claim the debt was not settled at the time then it should have been defaulted within 6 months of the agreement breaking down, so 2005 at the latest. If it had been defaulted at the correct time then it would have gone from your file by now. Furthermore it would appear likely the debt is statute barred in any case, having had no payments made and no acknowledgement since 2004.
    It would seem that way this has been handled is in the least in breach of the Information Commissioners Office guidance on defaults and quite possibly other data accuracy requirements. I would complain to ICO.

    Just noted that is has gone of the CRA's list today well last night it changed
