Nhbc

I made a claim to the NHBC for a large hole in the concrete that separates my leasehold ground floor apartment from the one above.The NHBC said the minimum claim was something like £1300 and it will cost more to do the work so that is ok but the management company of the building say the cost of the claim has to be multiplied by the number of apartments so unless the total repair bill is around £100,000 they say the claim in their opinion will be rejected.Anyone any experience in this kind of matter,i am not sure if the management company are trying to put me off as the NHBC say as long as the cost of the work is more than £1300 it will be ok

    I don't understand none of that

    If you are claiming against the Buildmark Warranty, then the management company has little say

    If you are covered in the warranty terms for the claim you are making, then the cost of the claim is irrelevant too

    The NHBC said to make a claim the cost of the repair has to be above £1300 otherwise they wont deal with it.The cost of the repair will be higher than that so they will action a claim.They have contacted the management company for info about the lease before any work can be done and in the meantime the management co has contacted me saying that the cost of any claims has to be multiplied by the number of apartments on the development which would mean that the work has to cost over £100,000 for them to give the go ahead to the NHBC.
    It all sounds strange to me.

    I can't understand where the NHBC has got the £1300 figure from. Surely a claim under the warranty is a claim, and not dictated by some arbitrary figure?

    As for the management company, are you sure that its not divided instead of multiplied by the number of flats? Normally repairs are pro-rated amongst all the leaseholders, but in any case, the company should be insured and this would come out of their own insurance and be nothing to do with the number of other flats

    I think that you need to get the NHBC to clarify their warranty terms of claim, and also the management company to explain their statement, as it just seems very odd and irrelevant.

    They said multiplied so any claim in any of the apartments have to be over £100,000 which sounds ridiculous and would mean the warranty is useless,it all sounds fishy to me.

    That part there pretty much sums the entire thing up.
    I don't know anybody that has a good thing to say about the NHBC.
