And bear in mind ... up to 6 months from purchase SOGA says it is for the Retailer to PROVE any fault is due to misuse, NOT for the consumer to prove it was not.0

If anyone is interested in the resolution to this, I went into a completely different Apple store today with all the information provided in this thread to hand and ready for an argument.
I sat down with a tech, explained what had happened exactly as I had done so before, and they gave me a brand new iPad with no questions, and no quibbles. I didnt even have to quote the terms of their warranty.
It just goes to show you how subjective these kinds of issues can be, and that sometimes it is purely the person you speak to on the day which will determine what will happen.
