car maintenance insurance problem

Hi all, we have had drivetrain insurance with bmw for around 12 months now. Last month the turbo went pop and we booked into the dealer garage where it was replaced and we paid the 100.00 excess. Today the dealer have called us saying they have put their claim in to the insurer (BMW) who have said they want to see the service book, unfortunately we don't have a book so they can't. We have a few receipts from past services recently although I was under the impression these were recorded on the cars computer. Can they now chase us for the cost of the whole repair or can I just say to replace the original turbo and refund our last 12 months premiums?

How old is your BMW, am i right to presume its now outside of it's manufacturer warranty period (usually three years).
Have a look at your policy wording or summary that would have been provided at the time of purchasing the drivetrain insurance, does it say on any of these that the insurer is entitled to reject a claim if you do not have a service book?
Did you buy the vehicle from the dealer that sold you the drivetrain insurance and did the vehicle not come with a service book?0 -
It's seven years old now, I bought the drivetrain insurance last year as the car was getting on a bit and it was the only warranty that still applied at the cars current mileage. I am aware the terms and conditions call for a up to date service schedule which it has, but I don't have the book just receipts. The car also has the service schedule on the in car computer which is updated by the technicians at service.
My gripe is that the work is completed, are they now entitled to worm out of paying and leaving me open to having to pay for work at twice the cost of an indepenent bmw dealer?, also if the car is not covered does the insurance code allow them to take premiums or should they be refunded?0
