just got a ccj form through - how do i deal with it?

Hi,

Had a huge chock on saturday. Got a ccj form through the post for a debt of £320 not £400 with costs.

I am so upset. I thought I had got all my debts on track and was looking to be debt free by end of the year - I just completely forgot about this!

I really want to try and sort it out without getting a ccj..... but I cant understand what I have to do...

Ideally, I would like to pay it over three months... It says on here that I would send the N9a direct to the claimant but will this still get me a CCJ?

Is the only way to avoid a CCJ is to pay the whole £400 off now?

Any help would be greatly appreciated!

Thanks x

sorry - just re-read this - It should say "huge shock" and, "debt of £320 NOW £400 with costs)
  • Yes, if you want it to disappear from your credit file, pay it within 28 days.

I have been there. Unfortunately for me, by the time I knew about it, it was already too late.
Mortgage deposit pot June 2012 = almost there.

    CCJ removal date = May 2014 :(

I am really confused - so I have 28 days? On here it says 14 days from service..... which is 5 days after is is dated (20th June) So the only way is to just pay the whole thing off? x

It's 28 days from judgement. However, if your letter says 14 days then I suggest you call them and ask for a clarification.

You get 28 days FROM the date Judgement was granted to satisfy it and have it removed.

The form you received is at a CLAIM FORM for the debt or an actual COUNTY COURT JUDGEMENT ?

    Hi

if the default letter is wrong, they cannot take court proceedings. If you have not received a default letter, they cannot take proceedings at all.

Do you have the default letter - issued about 3 months after you fell in arrears?

Not that I can remember but in all honesty this debt was run up a few christmasas ago (about 3 years ago) and it was then that we were a bit of a mess, son was in great ormonds street and my husband was having chemo so I just buried my head in the sand. We have since sat down and made our spreadsheet to pay off debts and have stuck to it - often overpaying but have obv totally forgotten about this.

I am devestated, cause I know that all defaults we have got are now paid off (well apart from this one!) cause we are hoping that once debts were paid off, we could then put the £1000+ a month we are paying them off with towards a house deposit - knowing by the time we have it all our credit reports will have had these defaults dropped off and we can start building up our score....

I think I just need to take a deep breath and deal with it.

Is a claim form not a CCJ then? I guess it is the formalities before a CCJ? xx
