Entitlement to holiday pay when made to work notice

Contractual holidays are those above the statutory minimum of 5.6 weeks(28 days for full time of 5 or more days a week)
Companies can make up their own rules for the extra contractual holidays.
I think it is important that you request the holidays so you have a record that the company did not allow you to take the holidays.
if you look at some of the tribunal cases to do with holidays(not the same as yours) they hinge on not being able to take the holidays as well as other things.0 -
I'm gobsmacked that such a ridiculous clause is in the contract, though I suppose I shouldn't be surprised as we all know how Vodafone doesn't like to pay its fair share - horrible company.
It could be that the £1 a day is only for holiday above the legal minimum, eg if you earn extra days for being at the company after a certain amount of time. Definitely challenge this ridiculous clause but don't let it stop you handing in your notice, it sounds like you need to get out of that mad house.0 -
For anyone wondering. I wouldnt have been able to use all my holidays at once if i booked them off as it also states in contract I cant book off more than 10 days holiday in one block. lol!debt free wanabeee0

Yesterday when I check the agreement I saw that also.
Anyway as soon as i got in today my manager sat me down and discussed. We talked about the clauseregarding the pay for holidays to which they replied the pound a day is what i will get. i explained i had been intouch with various people regarding employment law and that clause was not legal. I explained i want to make it as easy for everyone as possible and would not mind from tommorow taking any remaining holidays in my notice. they explained i may need to work a few days. i explained any left over days need to be paid at full rate and explained the law. they went away and come back and agreed I can work a normal shirt pattern for the next five days and serve the rest as holiday . Im on a rota and they have said i can just do normal hrs e.g 10-6.
Im glad i stuck this out as they definatly would hav screwed me over. im writing my notice shortly wen iv had dates from them confirmed. also am i right to ask fo written confirmation of all of this?debt free wanabeee0 -
Thanks for getting back on this. I'm glad you have been successful, it sounds like it was worth it!
Well done on sticking to your guns. Enjoy your break
Oh yes, I would absolutely be asking for this in writing, Just in caseThere are three types of people in this world. Those who can count and those who can't.0 -
Well done for getting them to agree.
IN your notice, write somthing like
I resign with x days/weeks/month notice.
(notice starts the day after) so my last day of employment will be ** July
AS agreed in meeting with X today, I will work X days and use Y days holiday so my last day in the office will be ** July
might be worth saying which days you will work.0 -

Probably end up with couple hundred quid and a few weeks off.
Im pleased with myself and the result. Im also quite knowledgeable about my rights too now which is the most important thing. im only a young lad!debt free wanabeee0 -

Surely you will just end up with a full months money if holiday is paid?0
