signing a consent form does NOT absolve the hospital in any way. I would agree with your GP and say that it is the follow up care which was negligent. I would certainly be seeing a specialist solicitor for advice.

In my opionion its a medical negligence specialist you need to speak to rather than a solictor.

They have expertease in that area and will be well able to advise on what course of action to take. I dont know where you live but I can certainly recommend one that does work all over the uk, they advised my oh in a case and were a great help.

    Hiya

Glad to speak with someone who knows about Stomas, I hate it! It distresses me every day, I try to carry on normal but not doing well!

I can't buy any new clothes as it being reversed, oh yeah they originally had reversal op booked for 10th July , but phoned me to say they cancelled it, so now another 5 weeks of waiting! As for changing bag....god that's a whole separate distressing issue!

Has a specialist stoma nurse been out to see you at home?

If not, try to find out if there is one in your area, they can really help you with the practical side of dealing with a new stoma and bag.

I hope it doesn't come to it but if you go down the litigation road, be prepared for a long wait before it goes to court.

I wish you well for a speedy recovery
It's nice to be important, but it's more important to be nice.

    Hi hun,
I really feel for you, I've just been quite poorly after a gynae op but nothing like as poorly as you! i was sent home with very low BP and an infection, and couldn't get a doc appointment for days, the aftercare stinks. I know you signed a consent form, but they have a duty of care to you and they have failed badly.
DH has a colostomy since he had a car accident. There should be a stoma nurse who will help you find the right bags and sticky stuff but getting used to having it will take time - by the time youve accepted it it will probably be gone!
DH felt quite bereaved when his was reversed, its a love-hate thing for him because although he hates having it he likes the security of knowing he's not going to have any accidents.

I have waffled a bit, sorry, just wanted to let you know you are not alone. If you think of anything poo-related you want to ask feel free to PM me, I've been dealing with DHs poo for years!
    Best wishes,

So sorry to hear your experience - I'm about to embark on medical negligence case as well - in my case two separate doctors not wanting to treat me as they insisted nothing was wrong with me and it now turns out I actually have womb cancer.
Really hope you get somewhere with this, it sounds awful what you've needlessly had to go through... :(

Breast cancer survivor has recently successfully sued her doctor (or hospital, not sure which), but it was a long and stressful process. Maybe you coud PM her?
Unless I say otherwise 'you' means the general you not you specifically.

Litigation will take hundreds of thousands out of the health care system.
So? They shouldn't have injured the OP in the way they did. Maybe the fear of loosing so much money will help dissuade them from treating people in such a terrible way.

OP, good luck whether you decide to take legal action or not.

No, it doesn't work like that. As soon as a legal claim is made the case is transferred over to the NHSLA, outside the Trust, and there is very little Trust involvement from that point onwards. A complaint will be handled internally, and the OP is far more likely to get some answers this way. A claim will be incredibly litigious, may easily take four years to resolve (some can take up to seven), and whilst the OP *may* get some money at the end of it, it is very unlikely that they will get any answers.

It is also worth noting that the Trust will not lose any money directly, that will be paid out by insurers. The only impact it will have on the Trust is that their insurance premium may increase.

So what the OP needs to work out is what they want out of this - answers, and to make sure it does not happen to anybody else, or cash.
