It couldn't be "other party at fault" as the laws governing game ownership mean that the poor deer became your property the moment it made contact with your vehicle!

I think a deer ran into the side of our car whilst we were driving at night through Windsor Great Park too.
As I recall there was no damage either way.

I've been there and done that with a deer - M5, at night; had a dent in the offside wing and hoof marks scraped down the side of the car. And a bit of blood on the front. Yuk.

Very very frightening and like you, I wasn't driving looking out the passenger side window, I was looking out the front. Even if I had looked out the passenger side window; it only shows at night once it's in the headlights; not all deer come with Rudolph noses. [In fact, I think that's made up, and not real at all].

Due care and attention indeed. Oh dear....
    [see what I did there?]

Terrible joke, but the post is pretty good ;)

I always tend to take one of the local (b?) roads at about 30 max at night because of the deer, it's not helped by the fact it unlit, twisty, wooded and hilly, so if you're going at any speed you have to have the reactions of Nigel Mansell to have a chance of avoiding any wildlife, even at 30 I've had a couple of close calls.

IIRC if you hit an animal and it damages your vehicle it's not a third party claim normally (as you can't claim off a Deer or Badger), unless it's something like escaped cattle, so you have to declare it, or at least inform your insurance company of the incident when renewal time comes up.

But the afore mentioned crowd deemed it still to be MY fault, lol......
Perhaps that's because many of us have seen your poor standard of driving via the videos you choose to share via YouTube. It's difficult to believe a known bad driver when he says the accident wasn't his fault!
  • Bet you that was expensive.

and now it looks like my car may be written off. It's all going through my insurance just now.

I've started looking around on line at other cars and looking for insurance quotes etc. My question is this: When I declare that I've had an accident is it fair to tick the 'other party at fault' box? No other vehicles were involved. I wasn't injured. The deer ran at me across the motorway and hit the drivers side of the car.

The difference in 'no other vehicle involved' and 'other party at fault' is quite substantial.

Had a deer jump over the bonnet of our MGA roadster one night - now THAT's scarey.

Now that you mention it, it took me a while to understand why my bike was covered in grass but hadn't left the road.

I'll leave you to work it out for yourselves.

  • I was going quite quick through some country lanes at night once. The roads were wet but it was not raining, a fox appeared in the middle of the road up ahead. I started slowing down but it ran off. I got off the brakes and then the stupid little !!!!!!! ran straight back in the road and even with ABS and 100% braking I had no chance. Thankfully, although not a pleasant experience, it went under both of my left wheels and didn't cause any damage to my car or cause me to lose control.
