Advice needed re: rent arrears/deposit dispute

Hi,

Me and my partner moved out of a house we were renting in February this year (it's been just over 4 months since we moved out) and yesterday we both received an E-Mail from the agency reminding us there were rent arrears of £541.75 still to pay..

Bearing in mind the agency convinced mydeposits that they were entitled to keep the entire deposit of £595 when we moved out for the following reasons, that they had to get a contractor in to do the below,

CARRIED OUT FULL HOUSE CLEAN
REMOVED OF AND DISPOSED OF ALL RUBBISH FROM INSIDE AND OUTSIDE OF PROPERTY
CUT FRONT AND BACK HEDGE
REMOVED WEEDS AND MOSS FROM GUTTERING
REPAIRED KITCHEN PLINTH
REPLACED DRAWER KNOB
REPAIRED WALL LIGHT
REPAIRED WARDROBE (LISTED IN INVENTORY AS DAMAGED ALREADY.......)
REPAIRED OVEN

Allegedly it cost £463.00 to do all of the above.

Now I got in touch with the contractor who they got to do the work, and made him aware that in the tenancy agreement it clearly stated that the kitchen 'plinth' which is listed on the inventory as a 'kickboard' was already damaged, so they took £16 off the £463 to make it £447.

I also E-Mailed the agency to inform them it was clearly noted on the inventory that they supposedly did a full house clean 3 months before we actually moved in, and before we'd signed and gave them the inventory back with our notes on it which clearly showed we disputed the full house clean that was allegedly done, which we also backed up with pictures (in the form of photographic evidence sent as attachments in E-Mail) of the wetwipes and cloths we had to use in the kitchen alone which showed all the filth we had gotten off the sides and surfaces in the kitchen, not limited to the kitchen sides/doors etc.

They also claimed for disposing of all rubbish inside and outside or property, there was 1 bag inside and ony the bins needed emptying outside the property, and when we moved out it was NOT the bin day for that week, so how much would this have cost for them to remove????......

They also charged us for them having cut the front and back hedge (we'd had it done 1 month before we moved out) now bearing in mind it was February when we moved out and we had it done in January, it wouldn't have grown that much.. Again how much would this have cost??

We've since seen the house on several occasions since we moved out and the garden at the front and back is like a jungle, clearly not been mowed in the 4 months since we moved out, the hedges are extremely overgrown and have also not been touched in 4 months since we moved out.

They also say they replaced the/a drawer knob (it doesn't state on what or which room) but in the inventory it says that on the second wardrobe it opens to three drawer units and that top draw will NOT open, this is quite clearly written by them in the inventory, it doesn't say it's because the drawer knob is missing but that is the reason why! We just didn't write anything in the inventory as they'd covered it... So we thought

It also says in the invoice we were sent that the contractor they used also had to repair wall light (it doesn't say which wall light) and there was only one wall light to our knowledge that didn't work and that was the outside light ON THE WALL.. We noted in the inventory THAT didn't work.. But we can't prove which wall light they allegedly repaired!

It says they repaired the wardrobe but in the inventory we noted that in one of the bedrooms the wardrobe doors were stiff to open! They did open but obviously in time would have needed repairing as they were extremely stiff! Again we can't prove which bedroom they allegedly repaired the wardrobe or what exactly it was they repaired but the only problem we knew about was the stiffness and difficulty to open the wardrobe doors in our daughters bedroom, so we can only assume that's what they repaired?

They also said they repaired the oven as the seal had 'gone' we didn't notice that at any point we used the oven! Surely we would have? Either way they charged for that as well.

We were only in the house for 1 year.

And since we moved out NOBODY has moved in, as we were told the reason the landlord wanted us to move out was because he had other plans for the house at that time, obviously those plans must have been put on hold..

Does anyone have some good advice for me please?

    All of the deposit deductions should have been challenged via the deposit scheme when you moved out. If you have accepted the deposit arbitration process then there is little point arguing it further.

    So are there rent arrears? If there are you will probably end up in small claims court if you fail to pay them.

    Can you please clarify the position re the rent arrears? Did you withold the final month's rent as a way of reclaiming your deposit?
    Warning ..... I'm a peri-menopausal axe-wielding maniac ;)
