    I have seen this on this forum before.

    You do have a case yes, so complain and collect your £50 compensation, but don't expect the debt to be written off due to this reason :T

    OP I have jsut read some of your other posts (i was genuinely interested to see what had previously been suggested to help you) - and I have to say I do not like your attitude to debt

    Your posts seem to be - Is my Halifax CC unenforceable, is my littlewoods catalogue debt unenforceable etc etc.

    Then you ask advice, and finish up getting an IVA.
    On another post claim that your husband is chasing Lloyds for a refund of PPI of £3k so that you's can get a new kitchen!
    I take it never crossed your mind to use the £3k (if you do get it - which i think you will be lucky too) to pay off your debts?

    Obviously everything you (as a couple) own is in your husbands name, and you claim benefits due to a disability, therefore your income as an individual is low, however your income as a couple maybe isn't - could you actually pay your debt if you took into account your husbands income?

    A couple is meant to support each other - for better, for worse.

    To me this doesn't include helping each other run away from their debts, it should be helping them pay it.

    Looking back at the OP's past posts it seems she is on a (failed) mission to have any debt she has ever taken out declared unenforceable.

    Not really no, as the irresponsibility rests in the person who spent any monies they could not afford to pay back, having an overdraft or credit limit is not a compulsory that means you HAVE to spend it.

    Having finally paid off my £3000 loan, the bank are offering me the World, an upgrade on my account, increase in my overdraft and yet another Credit Card offer. I not only do not need them, I know I cannot afford them. Common sense kicks in and tells me not to use them and remain debt free. No law in the land demands I must splash out with them.

    OP, you might want to take a look at the OFT's irresponsible lending guidance.
    If after reading that you still feel you have a case then by all means complain and request they write the debt off as a gesture of goodwill. It's their discretion as to whether they agree to it though but if you wanted to take a punt you could always take it to the FOS to let them decide if you don't get a suitable response to a formal complaint within 8 weeks..

    Yes, of course you can!!

    I assume they came around to your house and threatened to gouge your eyes out with hot pokers (and then feed them to you) if you didn't accept a loan that you clearly couldn't afford?

    You ought to take them to the European Court of Human rights, as far as I'm concerned.
