    this is complete nonsence , if you read my previos post regards to the £10 which is what they can charge and no more and by sending it ,it will not delay the process , also they have no legal right to pay the award of refund charges off the debt only if your on a iva ,otherwise you can ask for a cheque to be sent to your home address of course you cannot claim back anything if theres nothing to claim ,the charges are included in the balance of the debt owed thats why the person is sending for statements , i suggest you do a bit of studying before commenting

    pooch i suggest you read on !!!

    Add up your charges – You can claim for the last six years’ worth (under UK law, any more than that is considered too far out of date). If you don’t have all your statements, the bank is required to provide them to you under the Data Protection Act. You can find relevant addresses for different banks here and a letter template here. You can be charged a maximum of £10 for back statements regarless of quantity.

    I'm afraid Pooch is correct. Why would a bank give you a cheque for charges that are still on a card? The only way that this happens is if a balance is now 0 so the OP has actually paid the charge. If there is a balance on the card then obviously the charges are just refunded against this balance.

    If I had a card with a £100 of charges and the balance was £110 it means I owe £10. If they give me a cheque for the £100 refund of charges I'd still owe them £110 despite only spending £10 and i'd have £100 cash i'd effectively just taken off the card.
