EGG Credit card

Hi I have just had a letter from Egg saying that they are NOT going to uphold my complaint. Due to I click the box when I signed you online, and that they send me the T’s & C’s in the post with my credit card Agreement.
I do not really remember clicking the box so therefore do not remember them (the web site) going thought the PPI t’s&c’s etc.
However I do have the credit card agreement from when I signed it. Yes they did send me the “egg credit card payment Protection Policy”
AND in the covering letter it does say “What I have enclosed” and part of it is your EGG card payment protection policy” it goes on to say “what to do now” read the egg card agreement and the credit agreement condititions – it there is anything you are unsure of contact us...
SO in a nut shell I did not sign for the PPI - They did send me the t’s & c’s but did not say to read them.
I sent back the Credit card agreement that did not say anything about PPI.
So do I do now. Do you think I have a case?

Just a bit more (sorry) in the PPI Ts&c’s it says:
Termination.
The policy and any claim will terminate on the occurrence of any of the following;
fraud or dishonest application or claim
a benefit payment is made under the life cover
you reach the age of 65 years, normal retirement age at your place of work or state retirement age whichever is earlier
the agreement is terminated or if later you pay all sums due to egg following the termination of this agreement
you fail to pay three consecutive premiums

If you are sure you did not agree to PPI when you applied online for the credit card, why did you pay without questioning at the time the PPI charges as & when applied?
Btw, please read my reply. I just thought I'd mention that in case you didn't think it was necessary :cool:0 -
They cannot reject a claim fo mis sell by saying " we sent you the t&c " this is what FOS say.
Write back and reject the reasons they give for not upholding and show them you could pay the card back should the worst happen and why you had no need of this PPI, tell them about the t&c too.0 -
Hi I have called the financial ombudsman and made a complaint. what is the best reason to give them?

I think the reason this was declined was that you actively selected the PPI, and therefore it was not sold, but bought. The issuing of the T&Cs is secondary to this, but as they have to issue these to you they have mentioned it.

I to have had a egg card rejection the points i raised are
*I had my parents as other means of making repayment if i was unable to work through sickness accident or unemployment
*I remembered being told that if i took the insurance it would increase my chances of getting the loan approved
*When applying for the credit card i was having trouble online and was advised to tick the insurance as it saved me total protection and would help get the card approved.
*I was never given a full break down of what it would protect me with
*It was sold to me on the basis that I would get the loan and the credit card by taking the insurance only
A few points. Barclaycard were only taking the egg credit card. Nothing to do with any loan. I did take an egg loan but not at the same time I took the card. I have had a complaint upheld by egg about the loan.
They have gave the following reasons for refusing
I can confirm the Egg on-line purchase process
* Did not require me to take repayment protection insurance as a condition of obtaining the credit card
* Did not provide an advisory service
* Required me to positively confirm that i wished to purchase the policy during the on-line application
* Provided full terms and conditions of the policy and requested i read them before submitting.
I would be happy to provide a full copy of the letter to one of the experts on here to offer advise.
I also thought i read on here that up to 2001 all the PPI was automatic with egg cards?
My card was opened in March 2000.
This claim has been the most difficult for me as Barclay constantly said they lost paperwork and it has dragged on since March.
I look forward to some more great help and options

I also had a Credit Card with EGG. I have been in a battle with them for more than 18 months trying to get PPI misselling back. Hopefully the FOS will finalise this in the next month or so.

Can anyone confirm that egg had ppi pre ticked on all online applications prior to 2001?
If so would that in itself be a good basis to win a complaint. Based on my above post?0
