Struggling with ccj debt

    Don't give up yet...

    If they don't co-operate, send a sar (subject access request) it will cost £10 and they 40 days to comply. The sar should contain EVERYTHING relating to you and the case.

    It's not unusual at all for hceo's to charge way more in fees etc than they are allowed to.

    There is plenty of room left here for a fight with them.....;)

    Letter sent out recorded so they cant deny it turned it. I have asked for a copy of the original warrant/order and a breakdown of all charges past and present. Again, thanks guya for all your help.

    now i don't know much about HCE but what i do know if Gaunts are acting as HCE to enforce this debt the must have writ of fifa

    you may also be interested to know a writ of fifa only lasts 12 months

    I am 99% sure that Gaunts cant add interest to the debt
    there fees are astronomical however i belive most of them can be questiond

    I would start by sending them a subject access request
    I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

    havent had word from cn gaunt as of yet. Are they still allowed to take payment?

    It comes out as a "deb" so how do i lower that amount to £40 till i get it sorted thanks

    So today is day 22 and still no word from cn gaunt!!!!

    Still no word from the debt collection agency!! I have requested details of all the charges and also the original warrant etc. In the letter I stated that they had 21 days to comply with the letter. What do I do now?

    EDIT- I have just rang and they told me that they are waiting for the client to send them the files that I have requested. Is this not something they should have on record so they know how much they are legally allowed to charge?

    did you include the fee £10

    if yes they have 40 days to reply

    why don't you post on the consumer action group they have a forum dedicated to bailiffs and HCEO a few of the posters over there are very very good with HCEO
