Struggling with ccj debt

firstly I would like to say thank you for any help you can give me.

For the past few years I have been paying a ccj @ £100 a month for a debt that started at £5000 (new windows)

Unfortunately we ran into some hard times and couldn't afford to pay the window company. Anyway, the courts told us to repay at a rate of £40 which we were doing. I was getting some work so i upped it to £100 a month not realizing that a few years later the debt hasn't subsided at all. Even though I have almost paid back the total amount I have been charged left right and center from the bailiffs thus the debt stands at £4700!!! I am now in need of a reduction back down to the £40 a month but they debt collection agency are adamant I have to apply to the courts to do so.

Firstly, is there anything i can do to waiver the charges and secondly, is what they are saying correct?

    You need to write to the creditor asking for a detailed statement of account to include a breakdown of all these additional charges and go from there.

    Who is the creditor / dca - this seems very dodgy to me?

  • c n gaunt and son is the agency. But i upped the payment myself so I cant understand why I have to visit a court to lower the payments again.

    Im going to phone them again now

    Don't call - write.

    I need more info...

    1. Did the window company put this through finance and if so who?
    2. Do you have a copy of the original claim form?
    3. Do you have a copy of the judgement?

    You don't have to go back to court to reduce the payment, they are talking cobblers.
    So, you are making payments to the bailiff company?

    Do you have an accurate record of what you've paid to date?

    Find out how much you have paid in TOTAL.
    if this meets the value of the CCJ, tell them to whistle for the rest.

    Hi chip,
    No it was supposed to be payment upon completion but by the time they sent the bill we were strapped for cash and coundnt pay it back. Admittedly it was our own stupid faults and whats done is done. I dont have a copy of either documents im afraid

    Add up the totals you have paid and compare this to the ccj value.

    You really need to write to the court and get copies of that I mentioned. That's REALLY important.

    Do you have an accurate record of monies paid to date.

    Also, since judgement have you consistently made the monthly payments, or missed any. (Basically, how did this end up with the hceo ?)

    i have paid £100.50 since march 2008 and have bank statements to show to that affect. By the end of this month it will mean i have paid £5226. Once i get the email i will throw around some sums and come back on here- Much obliged for the help guys

    Chippy, back in 2008 i didnt respond to certain letters so the debt was passed on to the courts- since then i havent missed a payment
