My partner is 29 she was hit by a motorcycle when she was 12 and as a result has a paralysed arm and hand , pins in her ankle, minor brain damage, and various other health issues, she gets low rate DLA and they have taken her bus pass off of her as shes not disabled enough! She was given compensation which she has some left in a bond which she has no access to for 2 years, she was told when she was 18 that she did not need to declare this money as it was compensation and she went on JSA but the Job Centre then fined her 13K saying she should have declared it. 10 years later she needs to sign on and has her meeting on Monday, i have spoke to CAB who says she doesn't need to declare it but the girl didn't sound very sure of herself!
Can anyone give us any advice ?

Hi, your partner needs to make her claim into JSA and declare the money that is in trust, they will open a claim for her and the evidence will be looked at by a Decision Maker. As far as I am aware if she has no access to it at all and as long as it is declared at the point of claim it should not affect her benefit. However if she has the option to pay a penalty and take the compensation from the trust early this would affect it. Bottom line is make the claim and they will tell you if you are eligible or not.
