Just found out i got a CCJ can i fight it?

Hi ya all,

I just found out that i have a CCJ on my file and i dont know where its from?

I rang up the court who issued it me and they said it was for the sum of £170 and she gave me another number to call for the lewis group. So i rang them and just asked where it cam from and all they could tell me was that it was from GE capital which ment nothing to me so they said it was maybe from a store card from the EDGE group. But i dont use store cards or credit cards, they also told me that i had made previous payments towards the account in 2009.

Now they have my old address on file which maybe didnt help but can they issue me with a CCJ without my knowledge or without getting hold of me?
Also can i hold of the payments untill i know where this has come from?

Plus i thought that with a CCJ they have the power to find you and they can force you too pay as i have had a CCJ before and the money came out from my wages before it had been put into my account so why has they been no contact from them to me?

PLEASE HELP!!!!! where do i stand

    Do you acknowledge the debt now. They have your old address so there must be some connection

    Did you inform them of your new address,

    Did you redirect mail re the post office when you left.

    If they cant find you, they dont simply write off the debt. They couldnt know you have moved, some people just ignore debt collection letters, you could just as easily have been one of those.

    Hopefully someone will be along with advice on what to do now

    To be honest no i didnt but i was only at that property for 6 months and i would have let them know if there was any money outstanding plus they also had my mobile number and i did not hear from them.

    Yea my fault for not informing them of my move but its a CCJ so dont the courts have the power and right to find me and take it from my wages as before?

    Also how can i find out what it is for?
    How bad will it affect my in getting credit?

    If they don't have your current address then the only assumption is that you still live at your previous address, and that's where court papers will be sent. It's not the courts job to trace you, and if the creditor only has the one address there's not much they can do.

    Do you acknowledge a debt?

    In your earlier post, you said that you had no store cards or credit cards and that the details from the court meant nothing to you. So who are the people you refer to who had your mobile number?

    If it was a property that you rented then someone who followed after you vacated, will most probably have picked up your details from somewhere (non-forwarded mail?) and used your them to get credit in your name.

    It happened to my daughter when she was at uni.

    It's the problem you face if you are not meticulous in looking after your personal data.

    Even a debt of a couple of quid can escalat to hundreds by the time it has gone to debt collectors, court costs, bailiff costs.

    First thing to do is to make an application to get the court order set aside due to not being served. Bare in mind that the creditor could contest this though and even if you do win, te could request and be granted reasonable costs. If successfully, this will effectively put you in the position of not having the CCJ, with the option fir the creditor to the ake an application. Get it done as soon as possible though as you have a time limit from notice t make the application to set aside.

    david39- When i say they have my number i ment that every company that i owe money to will have my contact number and my address because i wont to get rid of these debts and starting getting better credit for myself
    And as of the people moving in ther after us, as it was rented then you could be right thats why i want to find out where its from before i start paying for it
    If i do find out where its come from and if it is my fault then i will put my hand up and say sorry and pay it off

    Also how bad will it look to future lenders for me?

    WOW this sounds great thenk you can you tell more how i can request this please?
    also how much will it cost?
    but will they just say that i didnt change my address therfore not accepting my request?

    If you have a CCJ you won't be touched for any further lending.

    If the CCJ papers were sent to a previous address because they were never informed of your current one at the time, then that would NOT normally be good enough grounds for a set aside on it's own.

    You usually need other good grounds besides that.

    You may have those, but you need to find out more info about the alleged debt first.
