A S SECURI-T Fine

Hi guys,

I have read a fair few threads already about these scammers. So far it looks as though the company has been closed down and shouldn't be operating anymore.

Well they still are as I received a PARKING charge notice a month or so ago (Im sure I still have the ticket somewhere at home) It said I had not used the premises that the car park was allocated too. I had in fact used a shop in the same area.

I did the wrong thing already which was email them to appeal as it stated I had not used klickfit, however I did another store in the same car park and I wanted to know if it was still valid just because I didn't park right next to the store.

I had no reply from them and thought they had left it until this week when I recieved a letter from ROXBURGHE debt collectors stating I needed to pay a fine twice the amount than before.

Again I did the worse thing possible and phoned them to find out why I know one replied to my email, The answer I got was that it was not a valid appeal so it was ignored. They also stated they had photographic evidence of me leaving the sight and going else where. Which will admit I did briefly go across the road to find out some information that I needed.

Luckily I used a work phone and didn't give them my home contact number. Do I still just ignore all letters etc from them? And is there someone I can complain to if A S SECURI-T are not meant to be operating still?

    No matter what the circumstances, you have not been fined, they can't enforce it and despite contacting them you should ignore from now on.

    Ok thanks for your advice. Does anyone know if there's someone/somwhere I can contact to complain? I don't see how DVLA can get away with giving out details to scammers.

    AS Securi-T those of High Street, Southampton or actually Oxford do not do court. They will however threaten all manner of gloom and doom if you don't pay them. As their invoices are simply speculative you can ignore them - and all the threats from Messrs Roxburghe's a debt collector of such standing that they have been subject of an investigation by the Office of Fair Trading for over a year. In May 2011 the OFT formally told Poxburghe that they were "minded to revoke" their debt collection licence.

    Expect another couple of letters from Roxborg including one from Graham White's, Solicitors. Don't be fooled though, Graham White's letters actually originate from Roxburghe hoping that the threat of a solicitor will prompt you into paying them an entirely made up amount.

    Stay strong.

    [Edit] - Absolutely do complain. Write to the DVLA complaining that AS Securi-T have no legal interest in the land it is alleged your vehicle was parked on and cannot therefore have satisfied the "reasonable cause" test required by Reg. 27 Road Vehicles (Registration and Licensing) Regulations 2002 under the provisions of which they will have obtained your details. Research around this so that you understand how the system works. These private parking companies are exploiting this and the DVLA are simply handing over registered keeper details so the PPC's can make millions - and it is millions.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    Ok, thats great I will send a letter to DVLA. Am I right in saying that AS SECURI-T are no longer a company with a licence to issue tickets?

    You've caused the landowner no financial loss whatsoever so ignore all their ridiculous letters full of made up 'crimes' like 'leaving site'.

    AS Securi-T was dissolved in 2011 according to the records. Certainly shouldn't be issuing tickets in that name now.

    I'm sure there would be many people interested in learning that they are still issuing tickets, or even collecting on unpaid tickets issued prior to the company being liquidated, not least the Official Receiver!

    You are entirely correct in stating that AS Securi-T Ltd were dissolved last year. However, AS Securi-T (minus the Ltd) is a legitimate trading title of VP Parking Solutions Ltd who are a member of the BPA Approved Operator Scheme.

    My apologies as I should have made that clear in my first post above. It is VP who have a registered office in High Street, Southampton (courtesy of Mailboxes Etc Ltd - a national accommodation address provider) but are more likely to be run from a business centre in Oxford although as that too offers a "virtual office" facility there is no guarantee it has a physical presence there either.

    It goes without saying that there is every reason to believe that VP Parking Solutions Ltd is the phoenix entity of AS Securi-T Ltd.

  • Hi all

    i got a fine from A S SECURI-T by parking in my local blockbusters car park for over £70 ! I parked my car and first went to a shop just by blockbusters to get a drink and went into blockbusters to look for cheap used DVDs.

    Went back to my car with a fine ! I was only gone 15 minutes. the fine was issued at the time I parked my car as well.

    After reading all these threads, should I irgone ? as I was in the wrong slightly by going to another shop to get a drink but went inside blockbusters afterwards.

    I am worried and need advice asap, please.

    its not a fine

    complain to blockbusters, wait for the empty threats to start arriving tell them to stop sending you threats, as its harrasment, tell that blockbuster store that they are liable for the actions of their agents, and if they dont stop harrasing you you may take action aginst both that blockbuster store, adn the parking company for harrasment

    Only councils, the police, train operators and Transport for London can impose legally enforceable fines or penalties. A private company or individual can't. Private parking companies (PPCs) call their tickets Parking Charge Notices, not Penalty Charge Notices. In law, they’re called speculative invoices.

    All the car park owner (CPO) can claim from a driver in damages for any alleged breach of any alleged contract is what they’ve lost as a result. If it’s in a free car park or the driver paid, this is £0.00. Demanding more has been judged to be unreasonable and therefore an unfair contract penalty under the terms of The Unfair Contract Terms Act 1997, which is not legally enforceable. See Dunlop Pneumatic Tyre Co. Ltd. vs. New Garage & Motor Co. Ltd., House of Lords, 1914 and countless cases since.

    There are also now recent landmark court cases, VCS Parking Control vs. Ronald Ibbotson, S!!!!horpe, 2012, HM Revenue & Customs vs. VCS Parking Control, Lower Tax Tribunal, 2012 and VCS Parking Control vs. HM Revenue & Customs (Appeal), Upper Tax Tribunal, 2012. In these cases, the judges ruled that only the CPO can charge for parking and take alleged offenders to court. The Upper Tax Tribunal is equivalent to the High Court, and therefore its judgements set legal precedents.

    Write to the CPO, advising them that they are "jointly and severally liable" for the actions of their agents, the PPC, and that any further actions by either of them would be regarded as harassment under the terms of The Protection from Harassment Act 1997. This ought to make the CPO call off the PPC and, maybe, also realise the potential cost of doing business with a PPC.

    Don’t appeal to the PPC. They always reject them. What’s in it for them to let anyone off?

    The PPC, then a debt collector and then a solicitor will send you a series of letters. The debt collector and solicitor are usually also the PPC, but using different headed paper. These letters will threaten you with every kind of financial and legal unpleasantness imaginable to intimidate you into paying.

    But, they can't actually do anything, for the same reason that a blackmailer can't take anyone who didn’t pay them to court.

    Continue to ignore everything you get from the PPC and their aliases. It does seem odd to deal with something like this by ignoring it. Eventually, they will run out of empty threats and stop throwing good money after bad.
    The acquisition of wealth is no longer the driving force in my life. :)
