Mobile phone insurance appeal - Policy Admin

Hey everyone I'm wondering if anyone can give me a bit of help or some ideas of what to include in my appeal letter for my mobile insurance.

Here's what happened - I was declined by my insurance (policy admin) to get my Iphone 4 back on the basis of

“Theft or loss (mobile phone only) where the phone or device has been left negligently or deliberately in a public place or a place to which other people have access to”

My phone had fallen out of my bag when I was in a taxi but I realised what had happened and rang the taxi company within minutes of getting out and I was told that they would ask the taxi driver to pull over and check the car and then they would ring me back. The taxi firm did not ring me back even after several calls from myself and friends to push the subject. Eventually I rang back again and was told they did not find anything and was hung up on.

I honestly believe that my request was not taken seriously and the taxi had picked up another customer where they had found my phone and taken it. I had also contacted the police and told them the situation however the taxi company does not operate a CCTV within their taxis and therefore unable to find out who had taken the phone (so obviously no evidence for my story). Friends and family members tried to ring my phone after 10 minutes of it being stolen and it had been turned off although when I had possession of the phone it was switched on with full battery.

I also explained that the taxi company I went with is a pre-book only company so therefore not just anyone can get in without them taking a name and address first.

I was hoping I may be able to get a quote or some piece of legislation that might see that I was treat unfairly. I just wanted to get across that if it was dealt with correctly I would of had my phone back, no problem but I was messed around.

Thank you for any suggestions, anything will help!

I'm not keen on this type of cover for mobiles (it seems very restricted) but I think the insurers have acted correctly. Not sure on what grounds you can appeal other than to their better nature.

Sounds like your issue is with the taxi firm but I don't foresee much success sadly.

Are you covered on your home insurance?
