ParkingEye - what to do in my situation?

Hi

I received a parking charge notice from ParkingEye after my son parked at a car park for 30 minutes where both meters would not accept his payment.

After reading numerous forums i've been given the impression that the best course of action is simply ignoring all notices and refusing to give the identity of the driver.

However, my son had already sent an appeal (which was of course rejected) in which he admitted to being the driver of the car at the time.

In the case that they did go to court (They've already pulled out the debt collectors letter), what would be the best course of action?

Would appreciate any advice!

    Even if you’ve written and told them who the driver was, it doesn’t make their actions any less unlawful. It just means that instead of harassing the registered keeper, they can now harass the driver.

    But, they still can't actually do anything, for the same reason that a Nigerian e-mail scammer couldn't sue anyone who didn’t pay them.

    Continue to ignore everything you get from the PPC and their aliases. It does seem counter-intuitive to deal with something by ignoring it. Eventually, they will run out of empty threats, and stop throwing good money after bad.
    The acquisition of wealth is no longer the driving force in my life. :)

    Parking Eye did actually win a P&D non payment case. They were awarded 2 X parking fee of £5 and 2 X DVLA request fee of £2.50 £15 in total.

    They claimed around £4000 in legal fees and were awarded £95.

    Cant see them going there again!

    In that case the Judge said if the fee owing would have been offered, they would have lost.

    It has been thought that sending them the fee due plus £2.50 DVLA fee and £2.50 for the letter sent would scupper them from the start.

    However I would ignore them, the chances of them doing anything more then the usual letter chain is very slim.

    The thing is there has been a higher court decision that is binding on lower courts since the above case, in that the judge said that companies have no legal right to offer parking services unless they basically own the land. So there is no chance that it will go to court as the defence would be primarily be that the higher court has determined that they don't have the right to sue.
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    You should offer them the cost of the pay and display fee add a goodwill gesture seeing as their machines were out of order and this should be stated.as a full and final settlement.if they continue to send threatening letters you will take it as harassment, as described under the protection from harrassment act.

    I would have thought that as the machines were out of order then they are not owed a penny? If there is no mechanism for paying the tickets then that's their hard luck.

    Compare and contrast this to something that recently happened to me in a council car-park There again all the machines were not working and the council warden told a group of us that as it was the council's fault then we could have free parking and there wouldn't be any comeback.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?
