ESA - what happens after the year?

My DH who has long term health problems was previously on IB, but was moved on to ESA in the WRAG. I know that this is only for one year which will run out in September. He will not be entitled to income related ESA as I work - which is OK and I understand that.

However, because of his illness, he will not be able to work, so would not be able to be deemed a 'Job Seeker' - even if he was fit, again he would not be entitled to anything because I work.

Will he simply just drop off the 'benefits radar' - by that I assume that as he is not being paid any benefits, he won't have to fill in any more forms or attend interviews etc.

    Whilst he continues to have Limited Capability for Work he will receive NI Credits which count towards a full State Pension, the DWP have said that they will continue to assess people in this situation.

    If at some time in the future, his condition deteriorates such that he meets the criteria for the Support Group, providing he has maintained his eligibility for ESA, he can be re-assessed and if successful, his ESA(CB) payments will be re-instated.

    If he continues to fullfill the criteria by completing the forms and attending medicals then he would continue to have his NI contributions paid. However they will not be paid if he doesn't complete the forms etc.

    on what basis?
    unless you dont have a partner who earns above £150 a week or no partner and savings below £16k you have no grounds for an appeal

    Thank you for your replies - he already has 30 years NI contributions - which I think is all you need to get a state pension.

    If he did not continue to complete the forms/attend medicals, could he re-apply as a new claiment if his condition did worsen, or would it mean as there was a 'break' in his claim, he would automatically be assessed under income related ESA

    If you do not continue to follow the process, and claim on a credits only basis, you have indeed broken the claim.

    It will not usually be possible to re-claim contributions ESA if your condition worsens and you qualify for the support group, with a break in the claim.
    I'm unsure if in principle short breaks of under 12 weeks may be OK.

    Just curious. Does anyone know what changes Universal Credit will bring to ESA support group allowance. Does it become income related then as well?
  • The Basic, that I am appealing is on CAB/BL advice, that I have limited mobility and need support in daily task, I have given evidence to support my claim using my DLA letter confirming the above, it,s noting to do with our income.

    ESA income-based is deleted, and becomes UC.
    Contributions-based ESA remains.
    As I understand it, someone in the position of having a 'credits only' contributions claim to ESA time-limiting may claim UC at the same time, and if they become entitled to support group, then the ESA will come back into payment.
    (presumably at this point UC will also reduce)

    So logically mpets' husband should continue sending in the forms etc , to have his NI contribution paid, so that if his condition eventually merits 'support' group he'd be eligible again for ESA CB support group?
