Mobile Contract - Failed credit check

Ermm any suggestion's on this. I just want to know who is in the wrong.

I ordered a mobile phone contract from Carphone warehouse, did it online, got sent the phone, when I went to activate the sim, the mobile provider were extremely shocked I had been sent a phone and asked me to return it to CW asap as I had failed the credit check.

Now you can imagine my annoyance, as I had set up the phone, added contacts etc, and now I have to take it back, which is fine, if I failed I failed. Im not a theif, however, Ive been intouch with CW(as my nearest is a fair few miles away) and I couldnt get in today

And a member of staff is saying I'll have to pay the full contract OUTRIGHT! Because they can't take the phone back as it has been used. Now were do I stand with this?? They've not tried to offer me a different mobile provider, theyre just saying I have to pay outright, but I don't know what my rights are with this, as obviously THEY sent a phone BEFORE I had passed a credit check, so surely this is their fault, not mine? And should make the contract not binding??

Any advice greatly appreciated.

    If I was you I would delete all your contacts off, if you can work out how, 'restore to factory settings'. Turn it off, bung back it in the box and write a stern letter containing your contact details and return it to them by RECORDED post only.

    Make sure they haven't set up any direct debits on your bank account and keep records of postage and the letter. When they have signed for it, ensure you print off the royal mail record on their website as they drop off after a period of time.

    It was their fault, they made a mistake, but you need to return it to them regardless. Don't bother sending it to a shop, send it to there head office. I believe the address is

    Carphone Warehouse,
    North Acton Business Park,
    Wales Farm Road,
    London W3 6RS.

    But call and double check. Yes, you'll end up paying the postage costs, no they won't refund you them, but you'll have it done and dusted!

    Because the forum now contains 'skim links' where links are made to other websites automatically.

    One more step up the ladder towards selling all our personal details for their financial gain.

    I am logged in and it isn't activated, and anway why would it link to a consumer action group?

    That will not be a skim link that has been copied from elsewhere as in copy and pasted.

    Anyway to the OP do not send back recorrded post as advised above If you cant get to the store, if you are going to send it send it Special Delivery because the cost of device will far outweigh the compensation from recorded.

    However I would be inclined to ask them to arrange collection at your conveinience. As for them saying you will have to pay for the contract outright that is total BS.
