section 21

We currently rent privately. We had a 6 month short hold tenancy agreement that began on 2nd Dec 2011 and expired 1st June 2012. During this time the property went to receivers due to landlord not keeping up with payments( all our rent payments have been paid on time and in full).

We have now receieved our section 21 notice. With notice to vacate by 1st sep 2012.

I have phoned the receivers to notify them it has been recieved and to tell them we intend to leave property on 14th July. I was then informed i still had to give at least a months notice. so we would still be payign rent after we had left.

Is this correct? If so seems a little unfair.

    They are correct. If you intend to leave before their two month's notice is up, you are required to give one rental-period's notice yourself. It's too late to give notice to end the tenancy on or by July the 1st, so your one month's notice would be for the period ending 1st of August. You can leave on the 14th of July if you choose but you need to pay the rent for the complete period of July if that's what they insist on. It might seem unfair to you but that's just the way it is.

    If they insist on rent insist on occupying the property until the day the rent expires.
    Keep the keys, keep paying the odd visit and dont give them up until the rent period has expired.
    Offer them the option to have vacant possession on the 14th if the rent is revoked.
    If they refuse, make them eat the cake they serve you, dont give them the keys until it has run out.

    thanks for quick response. just gonna have to move out later can't afford two sets of rent.
