What action can I take against the Council

Our neighbours fence has rotted and blown down. Theirs is a council property whereas ours is private.

The council say it is the tennants responsibility and have written to the tennant but they have done nothing.

The council are refusing to repair the fence but surely as the overall landlord of the property they have a responsibility to ensure that the property is maintained.

Can I take the council to court for failing to maintain their property - the same as you would do with a landlord of a private rent?

We cannot afford to, and do not see why we should pay to replace the fence when it is not ours.

The neighbours are all unemployed, layabouts who really dont care about the state of their house/garden and wouldnt have the money to replace the fence as they prefer to spend it on beer!

    There is no requirement to provide a fence so if you want a fence afraid you have to pay for it yourself.

    What makes you think the council own the fence any way? is this mentioned in the deeds? Even if it is they still don't have to put a fence up

    Indeed - the council are responsible for maintaining the border of the properties - but they dont have to do this with a fence. They can leave it open if they wish.

    If you want a fence there, you must put your own up, making sure the post side is your side, and the posts go into the ground on your property.

    Putting up your own fence is going to be infinitely cheaper than taking the Council to Court - especially if you lose and have to pay their costs!
    Warning ..... I'm a peri-menopausal axe-wielding maniac ;)
