Do I have a leg to stand for Compensation ???

Because I did not want to hijack the OP thread, I initiate this thread. I have similar experience to OP.

It was also about six years ago, I had one mispayment my Barclays card; this is due to their fault. At the time I asked to switch my direct debit to another bank. The Barclays card took that instruction from me by phone. They removed the DD from old account even before the DD come from the new account. For that reason I have one mispayment marked on my credit file and got mispayment penalty from Barclay Card.

I raised this issue to Barclays and they acknowledged that it was a mistake as I got refunded for the penalty charge that they had taken. But they did not want to send a notice of correction for the credit file as they said it was a mispayment, so it is correct based on their opinion although as I mentioned previously they acknowledged that they were the party who took the DD instruction and who remove my old DD instruction. IMHO they did not want to send notice of correction due to protecting their credibility.

The amount of mispayment itself was very insignificant as it was just about £25 (?) and I had saving account with some of them in from of instant access with the amount of a few thousand times of this sentry £25 available at that time. So here even a monkey could see that this was not a genuine mispayment but more to do with system error.

But the stupidity of the CRAs which could not recognize this error, and stubbornness of Barclay who did not want to send notice of correction had made me suffer for a few years. For instance, I got declined once for asking to increase my credit card limit when I was about to go for holidays. Although nowadays I have £3000 spending limit in my Barclays Card but I hardly use it as I now have half a dozen of other credit cards with higher spending limit and by far better benefit than Barclaycard such as cash back/rewards, zero fee for transitions in other foreign currency.

1) Is there any chance I could ask for compensation, from Barclays??
As it was about six years ago, I did not have any more paper work. I have online access to my Barclays card but I do not think I would be to see the six years old statement (?).

2) What evidence do you think I will need to stand a chance ??

3) If BarclayCard did not response, to whom do I need to raise this issue, FSA, Ombudsman??

    I'm not entirely sure what a mispayment is (do you mean missed payment? or a mispayment to the wrong account?) but I would say you have no chance and it's also not worth bothering over. As it was all done by phone, there is no way of proving anything.

    I'd move onwards and upwards.

    Hmmm, I'm wondering what you want to be compensated for.

    The missed payment marker obviously hasn't had much, if any, affect on your ability to get credit if you've managed to amass six credit cards with limits greater than £3,000 a piece during the past six years.

    And you weren't very concerned about it at the time, otherwise you would have made a complaint then.

    You appear to be jumping on the compensation bandwagon.

    Your main (only?) gripe seems to be that Barclaycard refused to increase your credit limit for holiday spending. As they would have been aware of the reason for the missed payment, I doubt that was the (sole) reason for them declining your request.

    It is NOT a default, simply stating that the relevant payment was late, as the following month would show it was back in order. There is little point in losing sleep over it, and certainly no compensation would be payable as was (a) accurate and (b) transient. Of all the markers, a late payment (as that was all it was) was resolved and anyone looking at the file will see this.

    I wouldn't get so worked up about it! And as it was 6 YEARS ago, it will soon not be visible to any enquirers.

    Whilst I am always up for securing as much compensation from companies as possible, even I wouldn't be bothering with this. You should have raised the issue of compensation with them at the time - NOT six years later, when you are now free of the black mark.

    Just move on.

    IMHO a single late payment wouldn't have a huge impact on your ability to get more debt from any other organisation, assuming everything else is in good order :)
