i just bought a car that passed MOT incorrectly

All that section means is that it must be fitted with a properly fitted fuel cap, not one of those universal twist in emergency ones.
If the MOT tester checked the cap and it appeared to screw in properly and wasn't loose then that is that, not dismantling is allowed, hence why a car can pass with pads with no meat whatsoever, as long as they pass the braking test.
From what the OP has stated the filler neck was corroded, rather than the metal surrounding the fuel filler neck.
As this can't be examined without taking bits off then it can't be checked.
And the only safety related check possible would be if there was a strong smell of petrol inside the vehicle.0 -
A hole in the fuel filler pipe would not prevent you from putting fuel in normally, quite the opposite.
With many fuel filler pipes covered by inner wheel arch liners and also with inner trim panels, I fail to see how he can claim it would be easy to spot on an MOT where you are not allowed to remove these panels.0
