redundant 2 weeks short of 3 years service

Options
I've been robbed - made redundant 2 weeks short of 3 years service

Is there any right to appeal? Pro-rata payment?

I did say when in consultation that they pro-rata all my other payments including holiday pay, final months salary why not redundancy?

and just to rub my nose in it one of the other staff told me about being made redundant from previous job where they made up his redundancy to 4 years (he was just short too)

Grrrrrrrrrrrrrrrrrrrrrrr

Amazed the law doesn't provide for this (whoooooooooooooole flippin year) and so I have to grovel to be treated respectfully

Nope - end of notice period (13th July) leaves me 2 weeks short of 3 years

I'm going to appeal directly to the MD (HR dont give a stuff) and you never know

My husband is in a similar position except he is 4 weeks short of 7 years and his notice periodwill take him over the 7 years.

Should the company pay him for the additional weeks. It is something neither of us had even thought about until I saw this post

Your entitlement is end of notice period - so he will get another year

If they pay PILON it is only the statutory notice that gets added or termination date if later for partial notice and PILON..

He was made redundant on Friday 22nd June. He is being being PILON the 6 weeks takes him up to the 1st week of august, he was working for them from the beginning of July on an add hoc basis to start training for the job. He is going to check his bank details to see when his 1st full pay was to find out his proper start date. When Natwest banking is up and running again.

It's not his bank statements he needs to check but his written particulars of employment which should state the start of employment.

If he started at the beginning of a July and had no break that included two Saturdays then employment is continuous from then to the time that he began after the ad hoc basis.

JUst to be clear Notice pay is based on service the daye of notice, so that looks like 6 weeks statutory notice.

Redundacy service is based on date of notice + statutory notice(or termination date if later).

So if the 6 weeks statutory notice takes him over 7 years that 7 years service for redundancy.

NOTE : Service is based on continuous employment so the continuous preriod before going full time counts toward the total. So some/all of the casual time will count allthough it looks like it won't make any difference.

As long as he was employed for any part of a week it counts.
